The Sponsor may appoint golf courses, charities, tournament operators, technology providers, event producers, independent judges, witnesses, prize insurers, contractors, sponsors, and other third parties to assist in administering the Promotion.

John Daly is scheduled to appear as the featured guest at designated portions of the Final Event. John Daly is not the Sponsor, administrator, prize insurer, or guarantor of the $1 million prize.

2. Official Promotion Name

The official name of the Promotion is:

Skill Shot $1 Million Shootout Featuring John Daly

The Promotion may also be referred to as the “Promotion,” “Shootout,” “Final Event,” or “$1 Million Shootout.”

3. Promotion Overview

The Promotion consists of:

A qualifying stage conducted through designated Skill Shot closest-to-the-pin tournaments and approved charity, golf-course, strategic partner, and promotional events; and

A private Final Event featuring John Daly and an insured $1 million hole-in-one competition.

Skill Shot intends to invite approximately 144 verified qualifiers to the Final Event.

Each verified qualifier who satisfies all attendance, eligibility, check-in, event, and insurance requirements will receive one official tee shot from a distance of 165 yards on a designated par-3 hole.

Each qualifier who makes a valid, verified, and insurer-approved hole-in-one with that one official shot will be eligible to receive a prize with an aggregate scheduled value of $1 million, paid as an annuity over 20 years.

Multiple separate $1 million winners are permitted, subject to the final insurance policy.

4. Promotion Period and Final Event Weekend

The qualifying Promotion Period begins at:

12:00 a.m. Central Time on August 1, 2026

and ends at:

11:59 p.m. Central Time on January 31, 2027

The private pre-party, Final Event, banquet, and $1 Million Shootout are anticipated to occur during the first week of March, 2027.

The precise Final Event date remains to be determined.

For purposes of these Official Rules, “Final Event Weekend” means the event period designated by Skill Shot for the optional pre-party, Final Event, Shootout, banquet, and related activities.

The final date, location, golf course, venue, schedule, and check-in deadlines will be announced after confirmation.

5. Geographic and Physical-Location Eligibility

5.1 Free-to-Enter Qualifying Tournaments

Free-to-enter qualifying tournaments are open to otherwise eligible legal residents of all 50 United States, subject to applicable law, the Skill Shot platform terms, and the rules of the applicable tournament.

Unless a tournament’s supplemental rules state otherwise, an eligible participant may take and submit a free qualifying shot from any of the 50 United States.

5.2 Paid Qualifying Tournaments

Paid qualifying tournaments are open to otherwise eligible legal residents of the United States.

Residency in Arkansas, Connecticut, Delaware, Louisiana, Montana, Pennsylvania, or South Dakota does not independently disqualify a participant.

However, no paid qualifying shot may be taken:

At a golf course located in Arkansas, Connecticut, Delaware, Louisiana, Montana, Pennsylvania, or South Dakota; or

While the participant is physically located in one of those states.

A resident of an excluded state may participate in a paid qualifying tournament by taking the qualifying shot at an eligible golf course in another state where paid participation is permitted.

For example, an Arkansas resident may participate in a paid qualifying tournament while physically present at an eligible golf course in Illinois.

The participant must remain physically present at the eligible golf course while:

Taking the qualifying shot;

Recording the qualifying shot;

Measuring the final ball location;

Completing the required GPS validation; and

Completing any required on-course submission procedures.

Skill Shot may separately restrict the purchase of entries, payment processing, or other account activity based on applicable law, geolocation requirements, payment-provider requirements, or Skill Shot platform terms.

5.3 Location Verification

Skill Shot may use reasonable methods to verify the participant’s physical location and the location of the applicable golf course, including:

In-app GPS information;

Device-location data;

Geofencing;

Golf-course coordinates;

Internet Protocol information;

Device and network information;

Payment information;

Submitted videos or photographs; and

Other location-verification or fraud-prevention tools.

A paid qualifying shot may be rejected if:

Required location information is unavailable;

The participant’s physical location cannot be verified;

Location information is inconsistent with the designated course or hole;

The participant or golf course was located in an excluded state;

The participant used a VPN, location-spoofing tool, emulator, remote-access service, or another method intended to conceal or misrepresent location; or

Participation otherwise violated applicable law or Skill Shot platform terms.

5.4 Changes to Permitted Locations

Skill Shot may modify the list of locations from which free or paid participation is permitted when reasonably necessary to comply with:

Applicable laws or regulations;

Licensing or registration requirements;

Court or regulatory decisions;

Payment-provider requirements;

Platform requirements;

Geolocation-provider requirements; or

Legal guidance.

Any material location restriction will apply prospectively and will be disclosed through the Skill Shot application or applicable tournament materials.

6. Age Eligibility

Every participant must be at least 21 years of age on or before the first scheduled day of the Final Event Weekend.

This age requirement applies regardless of the age of majority in the participant’s state of residence.

Each registered guest must also be at least 21 years old by the first scheduled day of the Final Event Weekend.

A participant who will not be 21 by the Final Event is not eligible to enter a qualifying tournament, receive a qualifying position, attend the Final Event, or take the official $1 million shot.

Valid, unexpired government-issued photo identification may be required during entry verification, qualifier registration, guest registration, hotel or venue access, and Final Event check-in.

7. Additional Eligibility Requirements

To enter or participate in a qualifying tournament, an individual must:

Be a legal resident of the United States;

Be at least 21 years old by the first scheduled day of the Final Event Weekend;

Be physically located in a jurisdiction where the applicable activity is permitted;

Use an eligible golf course and designated hole;

Maintain a valid Skill Shot account in the participant’s own legal name when participation occurs through the application;

Provide accurate identity, age, residency, physical-location, tax, payment, and contact information;

Permit Skill Shot to verify physical location when required;

Comply with the Skill Shot Terms of Service, Privacy Policy, tournament rules, and these Official Rules;

Complete all required validation, verification, release, registration, and tax documentation;

Be physically and legally able to attend the Final Event;

Comply with all applicable golf-course and venue requirements; and

Eligibility for the $1M Shootout must satisfy all applicable requirements imposed by Hole In One International, including not currently or previously holding a professional-status golfer designation.

Residence in Arkansas, Connecticut, Delaware, Louisiana, Montana, Pennsylvania, or South Dakota does not automatically make a participant ineligible.

Additional professional-status, handicap, occupation, equipment, or player-category restrictions may apply if required by the final prize-insurance policy.

8. Maximum Number and Allocation of Qualifying Positions

Skill Shot intends to invite approximately 144 qualifiers.

The initial planned allocation is:

116 Skill Shot tournament qualifiers;

20 charity tournament qualifiers;

8 promotional or contingency qualifiers.

The eight promotional or contingency positions may be used to accommodate verified qualifying ties, replacement qualifiers, canceled events, supplemental qualifiers, or other operational contingencies.

Because qualifying ties are expected to be rare, Skill Shot anticipates that the eight contingency positions will be sufficient to accommodate tied qualifiers.

The allocation may be adjusted as permitted by these Official Rules.

9. Skill Shot Tournament Qualifiers

Up to 116 qualifying positions are expected to be awarded through designated closest-to-the-pin tournaments conducted through the Skill Shot application.

Each tournament will identify:

Entry dates and times;

Whether entry is free or paid;

States from which participation is permitted;

Applicable physical-location requirements;

Entry fee, if applicable;

Eligible golf course or courses;

Eligible par-3 hole or holes;

Number of qualifying positions;

Submission requirements;

Scoring rules;

GPS and geolocation requirements; and

Tournament-specific terms.

For a paid tournament, the qualifying shot must be taken at a golf course physically located in a state where paid participation is permitted.

The participant’s state of legal residence does not independently determine eligibility for a paid tournament.

The highest-ranked eligible participant or participants will provisionally receive the announced qualifying positions, subject to identity, age, residence, physical-location, account, GPS, video, scoring, and submission verification.

10. Anticipated Back-Loaded Skill Shot Schedule

Skill Shot anticipates awarding the 116 Skill Shot tournament positions as follows:

Six positions between August 1 and September 11, 2026;

Twelve positions between September 12 and October 23, 2026;

Twenty-four positions between October 24 and December 4, 2026;

Fourty positions between December 5, 2026, and January 15, 2027;

Twelve positions between January 16 and January 22, 2027;

Fourteen positions between January 23 and January 29, 2027; and

Eight positions between January 30 and January 31, 2027.

Skill Shot initially expects each qualifying tournament to award one position. As participation increases, selected tournaments may award two or more positions.

The number of positions available in each tournament will be disclosed through the Skill Shot application or tournament materials before paid entries are accepted.

Skill Shot may move positions among weeks or periods based on:

Player participation;

User growth;

Course availability;

Weather;

Seasonal golf conditions;

Technical or operational considerations;

Geographic demand;

Legal restrictions;

Promotional opportunities; or

Remaining unfilled positions.

No announced qualifying position will be removed from a tournament after paid entries have been accepted.

11. Charity Tournament Qualifiers

Up to 20 positions may be awarded through approved charity tournaments, golf outings, fundraising events, or related golf competitions.

Each charity event must be approved by Skill Shot in writing before advertising or awarding a position.

The applicable rules will identify:

The participating charity;

Date and location;

Qualification method;

Number of available positions;

Entry fee or contribution, if any;

Scoring rules;

Tie treatment; and

Verification requirements.

A donation alone does not guarantee or improve a participant’s opportunity to qualify.

12. Promotional and Contingency Positions

Up to eight positions may be reserved for:

Verified qualifying ties;

Replacement qualifiers;

Canceled events;

Additional public qualifiers;

Promotional or media events;

Supplemental free or paid tournaments; or

Other operational contingencies.

Promotional and contingency positions will not be awarded solely through undisclosed private discretion. The recipient must complete a disclosed qualification process.

13. Reallocation of Positions

Skill Shot may reallocate unawarded positions among qualifying categories when reasonably necessary.

Reallocation may occur because of:

Tournament cancellation;

Insufficient participation;

Legal restrictions;

Charity or partner withdrawal;

Tie qualifiers;

Forfeitures;

Verification issues;

Fraud;

Weather; or

Other operational circumstances.

Skill Shot may reduce the number of qualifying positions allocated to a future tournament that has not opened for entry in order to accommodate verified ties or replacements.

No verified qualifier will be displaced solely because Skill Shot changes a future allocation.

14. Paid Entries

Unless otherwise stated in a tournament’s supplemental rules, ten (10) is the maximum number of paid qualifying entries that an eligible participant may submit in each qualifying tournament.

Each paid entry:

Applies only to the specified tournament or attempt;

Must be used for a shot taken at a golf course physically located in a state where paid participation is permitted;

Requires the participant to be physically present at that eligible golf course while taking and validating the shot;

Must independently comply with all Skill Shot rules;

Does not guarantee a successful shot, leaderboard position, qualifying position, or Final Event invitation;

May not be transferred to another person; and

Remains subject to transaction, responsible-play, account, payment, fraud, and platform controls.

A paid entry or shot may be rejected if Skill Shot cannot verify that the qualifying shot and required on-course validation were completed from an eligible state.

Tournament-specific capacity, course, daily, time, transaction, or attempt limits may apply even though no cumulative Promotion-wide maximum is imposed.

15. Free Entry Opportunities

Designated free-to-enter qualifying tournaments will be available to otherwise eligible legal residents of all 50 United States.

Unless supplemental tournament rules state otherwise, an eligible participant may take and submit a free qualifying shot from any of the 50 states.

Free tournaments may have different:

Entry windows;

Attempt limits;

Available golf courses;

Eligible holes;

Scoring formats;

Submission procedures;

Geographic requirements; or

Numbers of qualifying positions.

A participant is not required to enter a paid tournament to qualify through a designated free tournament.

Each tournament will be clearly identified as free or paid before entry.

16. One Qualification Per Person

A participant may earn only one Final Event qualifying position.

Once verified as a qualifier:

The participant may continue entering non-qualifying Skill Shot contests;

The participant is no longer eligible to earn an additional Shootout position; and

Any later qualifying position earned by that participant will pass to the next-highest eligible participant.

A position may not be sold, assigned, transferred, gifted, exchanged, auctioned, or substituted.

17. Tournament Scoring

Skill Shot qualifying tournaments will be scored according to the predefined rules and scoring criteria displayed within the Skill Shot application.

The applicable in-app rules are incorporated into these Official Rules.

Skill Shot’s scoring and eligibility decisions are final, subject to applicable law.

18. Minimum Shot Eligibility

For a qualifying shot to be eligible for scoring, the golf ball must come to rest on the putting green of the designated hole.

For purposes of this requirement, a ball is on the putting green when any part of the ball touches the putting green, as determined under the applicable Rules of Golf.

A ball resting entirely in any of the following locations is ineligible:

Fairway;

Rough;

Fringe;

Collar;

Apron;

Bunker;

Penalty area;

Another putting green;

Temporary green not approved for the tournament; or

Any location outside the designated putting green.

A ball that comes to rest in the designated hole satisfies the putting-green requirement and will be treated according to the applicable Skill Shot scoring rules.

The ball must remain at rest until the required measurement and submission procedures are completed.

19. GPS Distance Validation

Closest-to-the-pin distance will be measured and validated through the GPS and location functionality of the Skill Shot application.

Participants must:

Enable required location permissions;

Use a compatible device;

Follow all in-app measurement instructions;

Complete measurement at the ball’s resting location;

Avoid moving the ball before measurement; and

Submit all required supporting information.

Skill Shot may reject or adjust a submission when:

GPS data is missing;

Location data is inconsistent;

Instructions were not followed;

The recorded distance is unreliable or impossible;

The ball was moved;

Location spoofing or another prohibited method was used;

Required video is missing; or

The submission cannot reasonably be verified.

20. Video Submission and Validation

All qualifying shots must be recorded, submitted, measured, and validated according to the requirements displayed in the Skill Shot application at the time of entry and submission.

The in-app requirements may include:

Camera positioning;

Continuous recording;

Participant identification;

Hole and tee-box verification;

Ball-marker or code requirements;

GPS permissions;

Timestamp requirements;

Final ball-location confirmation;

Measurement procedures;

File-format requirements; and

Fraud-prevention controls.

Skill Shot may update technical requirements prospectively. An update will not invalidate a submission that complied with the requirements in effect when submitted.

21. Tied Qualifying Scores

If two or more eligible participants are tied for the final available qualifying position, each tied participant will provisionally receive a qualifying position, subject to verification.

Examples include:

If one position is offered and two participants tie for first, both qualify.

If two positions are offered and two participants tie for second behind one first-place participant, all three qualify.

A tie exists only when the final verified distances are equal under the Skill Shot application’s official scoring precision.

Additional positions created by verified qualifying ties will first be counted against the eight promotional or contingency positions.

Skill Shot may also accommodate verified ties by reducing the number of positions available in a future tournament that has not yet opened.

No previously announced qualifying position will be revoked after paid entries have been accepted.

22. Qualifier Notification

Potential qualifiers will be notified within 72 hours after the applicable qualifying tournament concludes.

Notification may be sent by:

Email;

In-app notification;

Telephone;

Text message; or

Another contact method provided by the participant.

A notification is considered sent when Skill Shot transmits it to the email address, telephone number, or Skill Shot account associated with the participant, regardless of when the participant opens, reads, or responds to it.

A leaderboard display, social-media post, verbal statement, or unofficial result does not constitute final confirmation.

Participants are responsible for maintaining current contact information and monitoring email, spam folders, voicemail, text messages, and in-app notifications.

23. Acceptance Deadline

23.1 Qualifiers Notified Before January 1, 2027

A potential qualifier notified before January 1, 2027, will have 14 calendar days from the date the notice is sent to:

Accept the position;

Confirm the intention and ability to attend;

Provide requested information;

Register a guest, if applicable; and

Complete initial documentation.

23.2 January Qualifiers

A qualifier notified during January 2027 must respond by January 31, 2027.

A participant notified on or after January 29, 2027, will receive at least 72 hours from the time the notice is sent, even if the deadline extends beyond January 31.

Failure to timely respond or complete requested information may result in forfeiture.

Skill Shot may extend a deadline when a technical, administrative, emergency, or other exceptional circumstance reasonably justifies additional time.

24. Verification

Potential qualifiers may be required to provide:

Government-issued identification;

Proof of age and residency;

Account verification;

Original video files;

GPS and device information;

Course confirmation;

Eligibility affidavits;

Liability and publicity releases;

Tax documentation;

Guest information; and

Insurance-related documentation.

A qualifying position is not final until Skill Shot provides written confirmation.

25. Forfeiture and Non-Transferability

A qualifier must personally attend the Final Event and complete all requirements.

If a qualifier cannot attend for any reason, the position is forfeited.

The position may not be:

Transferred;

Sold;

Assigned;

Gifted;

Used by a guest;

Rescheduled;

Redeemed for cash; or

Exchanged for another benefit.

Travel difficulty, illness, injury, scheduling conflict, lodging issues, transportation problems, or other personal circumstances do not create a right to transfer or reschedule the position.

26. Alternate Qualifiers

When reasonably practical, a forfeited or invalid position may be offered to the next-highest eligible participant from the original tournament.

If that person is ineligible, already qualified, declines, fails to respond, or cannot complete verification, Skill Shot may continue down the verified leaderboard.

If multiple participants are tied for an alternate or replacement position, Skill Shot may:

Apply a tiebreaker disclosed in the applicable tournament rules;

Conduct a supplemental skill-based playoff;

Conduct a supplemental closest-to-the-pin competition; or

Use another disclosed and verifiable skill-based procedure.

The general rule awarding all tied participants a position applies to ties for originally announced qualifying positions and does not necessarily require Skill Shot to award multiple positions when selecting one alternate.

Skill Shot may instead conduct an additional replacement tournament when:

No eligible alternate remains;

Records are insufficient;

The original tournament was canceled;

Multiple positions must be replaced; or

Another public skill-based method is more practical.

An alternate may be given a shortened response deadline based on the time remaining before the Final Event.

Skill Shot is not required to fill every forfeited position.

27. Guest Registration

Each qualifier may register one guest.

The guest must be registered within the qualifier’s applicable acceptance deadline.

Both the qualifier and guest must be at least 21 years old by the first day of the Final Event Weekend.

Guest information may include:

Full legal name;

Date of birth;

Email address;

Telephone number;

Identification information;

Emergency contact;

Required releases; and

Other event-registration information.

Failure to timely register a guest may result in the qualifier attending without a guest but will not automatically forfeit the qualifier’s position.

28. Guest Rights and Restrictions

A properly registered guest may receive admission to:

The private pre-party;

The Final Event; and

The post-event banquet.

A guest may not:

Replace the qualifier;

Take the official shot;

Participate in the $1 Million Shootout;

Transfer guest access;

Receive a qualifying position; or

Claim the cash value of an unused benefit.

29. Guest Substitution

A qualifier may request to substitute an eligible guest until 30 calendar days before the first scheduled day of the Final Event Weekend.

Any replacement guest must:

Be at least 21 years old;

Complete required registration;

Sign all required releases; and

Receive Skill Shot approval.

After the 30-day deadline, guest substitutions may be permitted only in Skill Shot’s discretion and may be denied because of:

Venue deadlines;

Security requirements;

Credential production;

Banquet counts;

Hotel or room-block lists;

Media and production requirements; or

Other operational considerations.

30. Travel, Lodging, and Transportation

Qualifiers and guests are solely responsible for arranging and paying for all travel, lodging, and transportation.

Unless later announced in writing, Skill Shot will not provide or reimburse:

Airfare;

Hotel accommodations;

Ground transportation;

Rental vehicles;

Airport transfers;

Fuel;

Mileage;

Parking;

Tolls;

Baggage fees;

Travel insurance;

Medical costs; or

Other travel expenses.

31. Discounted Hotel Room Block

Skill Shot intends to negotiate a discounted room block at one or more designated hotels.

The room block is offered as a convenience only and is:

Subject to availability;

Limited to specified dates and room types;

Subject to hotel policies;

Not guaranteed;

Not required; and

Not paid or reimbursed by Skill Shot.

Qualifiers and guests remain responsible for:

Reservations;

Room charges;

Taxes;

Fees;

Deposits;

Incidentals;

Parking;

Cancellations;

Damage; and

Alternative lodging.

Skill Shot is not a party to the lodging agreement and is not responsible for hotel disputes, overbooking, closures, reservation errors, room quality, or lost property.

32. Included Event Admission and Benefits

Each verified qualifier and one properly registered guest are expected to receive complimentary admission to:

The private John Daly pre-party;

The Final Event;

The $1 Million Shootout viewing areas available to guests; and

The post-event banquet.

Only verified qualifiers may take an official $1 million shot.

The precise food, beverage, entertainment, merchandise, golf-course access, parking, seating, and hospitality benefits included with each function will be announced after the venue and event package are finalized.

Unless expressly stated otherwise:

Travel and lodging are not included;

Alcoholic beverages are not guaranteed to be complimentary;

Additional guests are not included;

Unused admissions or benefits have no cash value; and

Event benefits may not be transferred or exchanged.

33. John Daly Pre-Party

John Daly is scheduled to be available at a private pre-party on the evening before the Final Event.

Attendance at the pre-party is optional.

Failure to attend the pre-party will not, by itself, cause the qualifier to forfeit the official shot.

Skill Shot does not guarantee:

A private meeting;

A round of golf with John Daly;

Individual instruction;

A specific amount of personal interaction;

An autograph;

An individual photograph; or

Participation in a particular activity with him.

34. John Daly Final Event Appearance

John Daly is scheduled to appear during the Final Event.

If John Daly cannot attend because of illness, injury, travel interruption, emergency, contractual issue, force majeure, or another circumstance beyond Skill Shot’s reasonable control, Skill Shot may:

Reschedule the appearance;

Modify the event;

Proceed without the appearance;

Offer another guest or experience; or

Take another reasonable action.

John Daly’s inability to attend does not automatically cancel the insured Shootout.

35. Final Event Check-In

Each qualifier must complete check-in on or before the deadline communicated by Skill Shot.

Check-in may require:

Identification;

Releases;

Credentials;

Equipment inspection;

Guest confirmation;

Shot-order information; and

Insurance documentation.

A qualifier who arrives after the deadline is not guaranteed admission or participation.

Skill Shot may admit or deny a late arrival based on:

Event timing;

Whether the assigned shot has passed;

Insurance requirements;

Witness and camera availability;

Security;

Venue access;

Safety; and

Disruption to the event.

Skill Shot is not required to delay or reorganize the event for a late qualifier.

36. Event Committee

“Event Committee” means the representatives designated by Skill Shot to administer qualifying tournaments or the Final Event.

The Event Committee may include:

Authorized Skill Shot personnel;

Host-course officials;

Judges;

Tournament administrators;

Production representatives;

Safety personnel; and

Other individuals appointed by Skill Shot.

The Event Committee will make operational decisions concerning event administration, participant conduct, shot order, staging, weather suspensions, Local Rules, and other event matters.

Hole In One International retains separate authority to determine whether a potential prize claim satisfies the final insurance policy.

37. Random Shot Order

The official shot order will be randomly drawn during the private pre-party.

Every verified qualifier will be included, whether or not the qualifier attends the pre-party.

The drawing may use:

Physical numbers;

Names;

Computerized randomization; or

Another reasonable random method.

The order may be adjusted for weather, safety, production, accessibility, venue, medical, or insurance reasons.

A qualifier may not trade, sell, or transfer the assigned order.

38. Staging and Participant Calls

Qualifiers must know their assigned position and report to staging when instructed.

Skill Shot may make up to three reasonable calls over approximately five minutes.

Calls may be made by:

Public-address announcement;

Event personnel;

Text message;

In-app notice;

Telephone; or

Another official method.

If the qualifier does not report, the Event Committee may:

Move the qualifier later in the order;

Place the qualifier at the end;

Hold the attempt temporarily; or

Forfeit the attempt.

A later attempt is not guaranteed.

39. Official Shot Distance

The insured par-3 shot will measure 165 yards.

The designated hole, teeing location, tee markers, pin location, measurement method, and any participant-category requirements will be determined in consultation with the host golf course and Hole In One International.

Any modification to the 165-yard distance must be expressly approved in writing by Hole In One International before the first official attempt.

40. Hole-in-One Prize Insurance

The $1 million prizes are intended to be insured through:

Hole In One International

The prize is subject to the final insurance contract, including all:

Conditions;

Limits;

Exclusions;

Participant requirements;

Shot-distance requirements;

Witness requirements;

Recording requirements;

Equipment requirements;

Claim procedures; and

Payment terms.

The insurance applies only to the insured hole-in-one prize and does not guarantee travel, lodging, event admission, John Daly’s appearance, application performance, or other benefits.

41. Applicable Golf Rules and Rules Hierarchy

Except where modified by these Official Rules, the Final Event supplemental rules, or mandatory prize-insurance requirements, official attempts will be governed by:

Mandatory written requirements of Hole In One International applicable to technical administration and prize validation;

These Official Rules and any Final Event supplemental rules;

The Rules of Golf jointly issued by the USGA and The R&A;

Local Rules and Terms of the Competition adopted by the host course or Event Committee; and

Instructions issued by authorized event officials.

Hole In One International’s policy requirements will control only matters involving the technical administration and validation of the insured $1 million shot.

They will not control unrelated matters such as guest registration, media rights, conduct, lodging, or event admission.

42. One Official Attempt

Each qualifier receives one official attempt.

No qualifier may receive a:

Mulligan;

Practice shot from the official tee;

Replacement shot;

Second shot;

Provisional shot;

Retake;

Replay; or

Substitute participant.

Once a qualifier makes a stroke with the intention of striking the ball, the attempt is considered used, subject to the applicable Rules of Golf and insurance terms.

43. Equipment

Qualifiers must use equipment permitted under the Rules of Golf and the insurance policy.

Skill Shot or the Event Committee may:

Inspect clubs and balls;

Require an approved or designated ball;

Mark the ball;

Prohibit altered or nonconforming equipment; or

Temporarily retain equipment for claim verification.

Refusal to comply may result in disqualification.

44. Witnesses and Recording

Each official attempt will be witnessed and recorded as required by Hole In One International.

Requirements may include:

Independent witnesses;

Event officials;

Continuous video;

Multiple camera angles;

Participant identification;

Ball identification;

Tee and hole confirmation;

Observation of the ball’s flight and result; and

Written certifications.

Failure to satisfy required witness or recording procedures may invalidate a prize claim.

45. Valid Hole-in-One

A potential winning hole-in-one occurs when the qualifier’s one official stroke causes the approved golf ball to travel from the designated teeing area into the designated hole and become holed under the applicable Rules of Golf.

A shot is invalid if:

Taken from the wrong teeing area;

Made by another person;

Made with unauthorized equipment;

Directed into the wrong hole;

Intentionally moved, redirected, or assisted;

Not properly witnessed or recorded;

Made after the attempt was already used;

Made by an ineligible or disqualified qualifier; or

Rejected under the insurance policy.

46. Potential Winning Ball

After an apparent hole-in-one, the qualifier may not remove the ball until authorized.

Event officials may first:

Record the ball in the hole;

Verify identifying marks;

Photograph the hole and flagstick;

Confirm witnesses;

Inspect the teeing area;

Preserve recordings; and

Complete insurance claim procedures.

The ball may be temporarily retained as evidence.

47. Final Prize Validation

An apparent hole-in-one is not an approved winning shot until reviewed and validated by:

Skill Shot;

The Event Committee;

Required witnesses; and

Hole In One International.

An on-site celebration, announcement, photograph, livestream, video, or social-media post does not guarantee payment.

48. $1 Million Annuity Prize

Each qualifier who makes a valid, verified, and insurer-approved hole-in-one will be eligible to receive a prize with an aggregate scheduled value of:

$1,000,000

The prize will be paid as an annuity over 20 years.

The advertised $1 million amount represents the aggregate of all scheduled payments and is not an immediate $1 million cash payment.

Subject to the final policy, the anticipated structure is 20 annual payments with a total scheduled value of $1 million.

The final insurance documents will control:

Payment amount;

Payment date;

First-payment timing;

Payment provider;

Beneficiary rights;

Treatment upon death;

Assignment restrictions;

Tax reporting; and

Any lump-sum option.

49. Multiple Winners

The Shootout is not limited to one winner.

Each qualifier who independently makes a valid, verified, and insurer-approved hole-in-one may receive a separate $1 million annuity prize.

Sponsor intends to obtain insurance permitting multiple covered winners.

50. Taxes

All federal, state, and local taxes associated with prizes or event benefits are the sole responsibility of the recipient.

Potential winners may be required to provide:

Social Security number or taxpayer identification number;

IRS Form W-9;

Other tax documents; and

Documentation required by the insurer or payment provider.

51. Weather and Suspension

Skill Shot, the host course, the Event Committee, or Hole In One International may delay or suspend play because of:

Lightning;

Severe weather;

Wind;

Rain;

Flooding;

Unsafe conditions;

Darkness;

Heat or cold;

Air quality;

Medical emergencies;

Government restrictions;

Equipment or camera failure;

Course closure; or

Another safety or insurance concern.

Qualifiers must stop immediately when instructed.

52. Completed and Interrupted Attempts

A valid attempt completed before a suspension remains used and will not be repeated.

If play is suspended before a qualifier makes the official stroke, the attempt may be preserved until play resumes.

Ordinary changes in weather, wind, temperature, turf, or visibility after resumption do not create a right to another attempt.

53. Postponement or Rescheduling

The event may resume:

Later the same day;

On another date;

At the same hole;

At a substitute insured hole;

At another approved course; or

Under another insurer-approved setup.

Qualifiers are responsible for additional travel, lodging, and personal expenses arising from a postponement.

A qualifier unable to attend a rescheduled event may forfeit the attempt.

54. Cancellation

If the Shootout cannot reasonably be completed or rescheduled, Skill Shot may cancel remaining attempts, subject to applicable law and the insurance agreement.

Qualifiers are not automatically entitled to:

Cash;

Travel reimbursement;

A substitute prize;

A future Shootout position; or

Another attempt.

55. Conduct

Skill Shot may deny admission, remove, suspend, or disqualify any qualifier or guest whose conduct is:

Unsafe;

Disruptive;

Abusive;

Threatening;

Unlawful;

Excessively intoxicated;

Fraudulent;

Destructive;

Unsportsmanlike; or

Otherwise unruly or inappropriate.

Prohibited conduct includes:

Fighting;

Harassment;

Interfering with another shot;

Refusing reasonable instructions;

Damaging property;

Unsafe use of equipment;

Unauthorized access;

Disrupting the livestream or production;

False identification;

Cheating or collusion; and

Conduct creating safety, legal, insurance, operational, or reputational risk.

Skill Shot is not required to provide a warning before removal when immediate action is reasonably necessary.

56. Effect of Removal or Disqualification

A removed or disqualified qualifier may forfeit:

Event admission;

The official shot;

Guest privileges;

Unclaimed benefits; and

All rights associated with the qualifying position.

Serious guest misconduct may also result in removal or disqualification of the associated qualifier.

57. Publicity and Livestream Consent

As a condition of accepting a position and attending the event, each qualifier and guest must consent to being:

Photographed;

Filmed;

Livestreamed;

Interviewed;

Audio recorded;

Profiled; and

Publicly identified.

The event is intended to be livestreamed and widely publicized.

58. Grant of Media Rights

To the extent permitted by law, qualifiers and guests grant Skill Shot and its authorized affiliates, licensees, production partners, media partners, sponsors, successors, and assigns the right to use their:

Name;

Image;

Likeness;

Voice;

Appearance;

Biography;

Hometown;

Statements;

Interviews;

Golf performance;

Qualifying history;

Official shot;

Reactions;

Event participation; and

Prize result.

These materials may be used worldwide in any media now known or later developed for:

Livestreams;

Broadcasts;

Social media;

Advertising;

Promotion;

Editorial coverage;

Documentaries;

Entertainment;

Skill Shot content;

Archival use; and

Future promotional campaigns.

Unless prohibited by law, no additional compensation, notice, review, or approval is required.

59. Media Cooperation

Qualifiers may be required to reasonably cooperate with production, including:

Brief interviews;

Biographical information;

Microphones;

Media staging;

Camera positioning;

Winner announcements; and

Prize-verification activities.

A participant will not be required to make a false statement or endorse a position the participant does not genuinely support.

60. No Expectation of Privacy

Except in restrooms, changing areas, hotel rooms, or other places where privacy is reasonably expected, qualifiers and guests should expect event activities and conversations to be recorded or observed.

61. Personal Recording Restrictions

Skill Shot may restrict personal recording, livestreaming, photography, or social-media posting to protect:

Safety;

Broadcast rights;

John Daly’s publicity rights;

Sponsor rights;

Insurance verification;

Confidential content;

Other participants; or

Event operations.

Qualifiers and guests must comply with all embargoes, credential rules, restricted-area rules, and recording instructions.

62. Required Releases

Qualifiers and guests must sign all reasonably required:

Publicity releases;

Media releases;

Appearance releases;

Liability waivers;

Assumption-of-risk acknowledgments;

Medical authorizations;

Confidentiality agreements; and

Venue or insurance documents.

A qualifier who refuses may forfeit the position and official attempt.

A guest who refuses may be denied admission without automatically disqualifying the qualifier.

63. Assumption of Risk

Qualifiers and guests voluntarily assume the ordinary and inherent risks associated with golf, travel, weather, crowds, entertainment events, alcohol service, and related activities.

Risks include:

Being struck by balls, clubs, carts, vehicles, or equipment;

Falls;

Uneven terrain;

Weather exposure;

Illness;

Physical exertion;

Golf-cart accidents;

Food or beverage illness;

Intoxicated persons;

Travel accidents;

Theft or property damage;

Communicable illness; and

Other known and unknown event-related risks.

64. Liability Release

To the fullest extent permitted by law, qualifiers and guests release and agree not to sue:

Skill Shot, LLC;

John Daly and his representatives;

The host course and venue;

Hole In One International;

Participating charities;

Sponsors;

Partners;

Hotels;

Vendors;

Contractors;

Production companies; and

Their respective owners, officers, directors, employees, agents, insurers, and representatives.

The release applies to claims arising from attendance or participation, including ordinary negligence, to the extent such claims may legally be released.

The release does not apply to liability that cannot lawfully be waived.

65. Medical Care

If a qualifier or guest is unable to provide instructions during a medical emergency, the person authorizes event personnel to request or arrange reasonably necessary care.

The qualifier or guest remains responsible for all medical and transportation expenses.

66. Personal Property

Qualifiers and guests are responsible for their own:

Golf equipment;

Vehicles;

Luggage;

Electronics;

Valuables; and

Other property.

The Released Parties are not responsible for lost, stolen, or damaged property except where liability cannot legally be excluded.

67. Indemnification

To the fullest extent permitted by law, each qualifier and guest agrees to indemnify the Released Parties against third-party claims arising from the individual’s:

Intentional misconduct;

Unlawful conduct;

Fraud;

Cheating;

Property damage;

Rule violations;

Failure to follow safety instructions; or

Conduct causing injury or damage.

68. Technical Failures

Skill Shot is not responsible for:

Internet or cellular interruption;

App outages;

Upload failure;

Corrupt files;

Device failure;

Battery or storage issues;

GPS inaccuracy;

Camera failure;

Lost or delayed submissions;

Unauthorized access; or

Other technical problems beyond its reasonable control.

Participants remain responsible for confirming that submissions were properly completed.

69. Fraud and Prohibited Conduct

Participants may not:

Use multiple identities;

Share accounts;

Submit another person’s shot;

Edit or manipulate required video;

Falsify GPS, distance, time, score, or identity data;

Use location-spoofing technology;

Use bots or automation;

Collude with another participant or official;

Bribe an official;

Tamper with the ball, hole, tee, camera, or measurement process; or

Interfere with the application or event.

Skill Shot may investigate suspected misconduct and share relevant information with insurers, courses, venues, law enforcement, regulators, or affected parties.

70. Sponsor and Event Committee Decisions

Skill Shot, the Event Committee, designated judges, and Hole In One International will interpret and apply these Official Rules in good faith.

Skill Shot and the Event Committee will decide matters involving:

Scoring;

GPS validation;

Video validation;

Eligibility;

Qualification;

Conduct;

Check-in;

Shot order;

Staging;

Event administration; and

Operational disputes.

Hole In One International will determine whether a potential winning shot satisfies the final insurance policy.

All decisions are final, subject to applicable law.

71. Supplemental Rules and Order of Precedence

Each qualifying tournament and the Final Event may have supplemental rules.

If these Official Rules conflict with a qualifying tournament’s published in-app rules:

The in-app rules will control the technical operation, entry process, submission requirements, measurement, and scoring of that qualifying tournament; and

These Official Rules will control eligibility for and participation in the Final Event.

If either these Official Rules or in-app rules conflict with a mandatory requirement of the final Hole In One International policy, the insurance requirement will control only the technical administration and validation of the insured $1 million shot.

If an advertisement or promotional statement conflicts with these Official Rules, these Official Rules will control.

72. Privacy

Participant information may be used to:

Administer the Promotion;

Verify identity and eligibility;

Prevent fraud;

Communicate with participants;

Register guests;

Coordinate the event;

Process insurance claims;

Process tax reporting;

Arrange media coverage; and

Comply with legal obligations.

Information may be shared with courses, venues, charities, insurers, payment providers, production companies, hotels, legal advisers, tax professionals, contractors, and government authorities as reasonably necessary.

73. Modification or Termination

Skill Shot may modify, suspend, relocate, reschedule, or terminate the Promotion when fraud, technical failure, weather, venue issues, legal requirements, insurance requirements, safety concerns, force majeure, or other circumstances materially affect its administration.

Skill Shot will not revoke a validly earned and verified position solely to reduce the number of qualifiers.

74. Severability

If any provision of these Official Rules is held invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
